  2.             LICENSE AGREEMENT AND LIMITED WARRANTY

  4. IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THIS 
  5. SOFTWARE.  BY USING THIS SOFTWARE AND ACCOMPANYING MATERIAL 
  6. ("SOFTWARE PRODUCT") YOU ACCEPT THE TERMS AND CONDITIONS OF THIS 
  7. AGREEMENT.  IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT DO NOT 
  8. INSTALL OR USE THE SOFTWARE PRODUCT AND RETURN IT TO YOUR PLACE OF 
  9. PURCHASE FOR A FULL REFUND.

  11. COPYRIGHT/OWNERSHIP.  The Software Product is owned by Pixel Planet 
  12. Corporation and is protected by copyright and other laws.  Pixel 
  13. Planet retains all right, title, and interest, including all 
  14. intellectual property rights, in the Software Product.  You aquire 
  15. only the right to use the Software Product, and do not acquire any 
  16. rights, express or implied, in the Software Product other than those 
  17. rights specified in this Agreement.

  19. LICENSE.   You may use the Software Product for personal use on one 
  20. computer at a time.  You must run the Software from the CD-ROM 
  21. (although the Software itself may copy a portion of the Software 
  22. onto your hard drive during installation in order to run more 
  23. efficiently).  You may not make copies of the Software Product.  
  24. You may not distribute the Software to others or electronically 
  25. transfer the Software from one computer to another over a network.  
  26. You may not use the Software from multiple locations of a multiuser 
  27. or networked system at any time.  You may not reverse-engineer, 
  28. disassemble, or decompile the Software. You may not rent, lease, 
  29. license or otherwise transfer the Software Product without written 
  30. consent of Pixel Planet, except that you may transfer the entire 
  31. Software Product on a permanent basis, provided the recipient 
  32. agrees to the terms of this Agreement.

  34. TERM.  You may terminate this Agreement at any time by destroying 
  35. the Software Product along with any portions copied onto your hard 
  36. drive.   This license is automatically terminated if you fail to 
  37. comply with any term or condition of this Agreement.  Upon such 
  38. termination you agree to destroy the Software Product along with 
  39. any portions copied onto your hard drive.  
  40. U.S. GOVERNMENT RESTRICTED RIGHTS.  This Software Product is 
  41. provided with restricted rights.  Use, duplication, or disclosure 
  42. by the Government is subject to restrictions as set forth in 
  43. subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer 
  44. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) 
  45. of the Commercial Computer Software - Restricted Rights at 
  46. 48 CFR 52.227-19, as applicable.  The manufacturer is Pixel Planet 
  47. Corporation, PO Box 85778, Seattle WA 98145-1778.

  49. LIMITED WARRANTY.   Pixel Planet warrants that the Software will 
  50. perform substantially in accordance with the accompanying 
  51. documentation for a period of ninety (90) days following the original 
  52. purchase.  Pixel Planet's and its suppliers' entire liability and 
  53. your exclusive remedy shall be, at Pixel Planet's option, either the 
  54. repair or replacement of the Software Product, or a refund of the 
  55. price paid for the Software Product.
  56. NO OTHER WARRANTIES.  PIXEL PLANET AND ITS SUPPLIERS DISCLAIM ALL 
  57. OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT 
  58. LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A 
  59. PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE 
  60. SOFTWARE PRODUCT.  This limited warranty gives you specific legal 
  61. rights.  You may have others which vary from state to state.

  63. LIMITATION OF LIABILITY.  IN NO EVENT SHALL PIXEL PLANET OR ITS 
  64. SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR 
  65. CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR 
  66. INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF PIXEL PLANET HAS BEEN 
  67. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  PIXEL PLANET'S AND ITS 
  68. SUPPLIERS' ENTIRE LIABILITY SHALL NOT EXCEED THE LICENSE FEES PAID 
  69. BY YOU FOR THE SOFTWARE PRODUCT.  Because some states do not allow 
  70. the exclusion or limitation of liability, the above limitation may 
  71. not apply to you.

  73. GENERAL.  This license constitutes the entire agreement between you 
  74. and Pixel Planet regarding your use of the Software Product.  This 
  75. Agreement is governed by the laws of the State of Washington.
